As stated in an earlier post the daily grind for a private investigator is more like likely to be finance rather than infidelity. This manifests itself as Process Serving. The ease of borrowing money in our private lives is mirrored in the commercial world where more often than not, the sums are far greater.
Many of the papers we ’serve’ are against companies who have borrowed more than they can afford and are unable to meet the terms of an agreement or contract. Others are against individuals who live far beyond their means and earnings. Many companies are forced to cease trading and many individuals are declared bankrupt. The creditor is then left with the decision to trace the persons responsible for the mismanagement of the funds and try for recompense through the court system. Our services are then called upon to trace, locate and ‘serve’ those involved. otherwise known as ‘Trace & Chase’.
These are not the only types of ’serves’ we conduct though. As we all know a large proportion of marriages end in divorce for one reason or another. Very often there are plenty of loose ends to be tied. Mortgage, Children, Loans, and even who gets the dog?
When all communication has broken down and solicitors are involved, a couple can spend a fortune through their legal representatives sending one letter after another. Which in a lot of cases is failed to be responded to.
We as Process Servers are then tasked with the often sensitive job of seeking out the evasive partner and ensuring that they do receive the necessary papers. We then present ourselves to the court to swear an Affidavit confirming this fact.
As a person who is not party to the litigation and not going to benefit either way, our sworn affidavit is accepted by the court as assurance that the service was completed. The court process can then proceed in the absence of the named party, should they continue to ignore correspondence from the legal system.
